WFTF 2023 Terms and Conditions

1.Definitions and interpretation

“WFTF 2023” means World Field Target Competition 2023

“Event” means the WFTF 2023, a sporting event including, without limitation, a seminar or seminars, exhibitions, competitions, theatrical and/or musical events to be held at a Venue in respect of which the South African Field Target Association (hereinafter called “SAFTAA”) have the right to sell You Places.

“Places” means Places for an Event sold by Us to You on behalf of the organisation responsible for the Event for the right to occupy space at or to attend an Event.
“Venue” means any facilities or locations of any nature where the Event is being held.

“We” means SAFTAA “Us” and “Our” shall be read accordingly.

“You” means You or anybody who in Our reasonable opinion is acting with Your authority or permission. “Your” shall be read accordingly. You does not mean an individual, it means a Regional Governing Body (hereinafter called “RGB”).

“Promoter” means the person firm or company staging the Event if different from Us and the Venue.

“Group” means group or other organisations that We have agreed to sell to knowing that the Places are intended for resale.

“Confirmation” means a certified official written document containing details of the Places You have purchased as an RGB on behalf of your members.


2. Incorporation

These Terms and Conditions are incorporated and should be read in accordance with the Venue’s terms, conditions and regulations, copies of which are available upon request from the Venue. In the event of any inconsistency between the terms in relation to Venue or Event requirements, those of the Venue shall prevail.


3. Places

All Places are sold subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase as purchase of Places constitutes acceptance of these Terms and Conditions.

We confirm that We are authorised to sell Places for the Competition, Courses and Ceremonies at WFTF 2023.

A valid confirmation must be produced to participate in the Event. Removing any part of, altering or defacing the confirmation may invalidate Your Place.

It is Your responsibility to check the confirmation as if You have made a mistake or mistakes they cannot always be rectified after purchase. Please check Your confirmation on receipt carefully and contact us immediately if there is a mistake.

We will not be responsible for any confirmation that is lost, stolen or destroyed. It is not always possible to issue duplicate Places where there is a possibility of both the original and duplicate Places are being used, compromising the licensed capacity of the venue. Duplicates may therefore be issued at the discretion of the Venue and Us acting reasonably. In the event of duplicates being issued, a reasonable administration charge may be levied by Us.

We reserve the right to provide alternative Places and/or seats at an Event to those specified on the confirmation should the staging of the Event so reasonably require, provided they are of no less value to that stated on the confirmation.

Ownership or possession of a confirmation does not confer any rights (by implication or otherwise) on You to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the confirmation.

You understand that the Event is run under WFTF and SAFTAA Rules and these maybe subject to change after Places have been confirmed and Your payment is made.


4. Price and payment

The price of the Place shall be the price set at the time We accept Your order. All prices set are inclusive of any applicable taxes but exclusive of any booking fee and collection or delivery fee. No order will be accepted until We have received full payment.


5. Delivery

We reserve the right to make Places available for collection only at the Venue. You will be notified by email of the arrangements for collection (using the details provided at the time of ordering).

When You are collecting Your Places from the Venue, You must have Your confirmation of order with You. You will only be able to collect Your Places at registration on Day 1.


6. Changes to Event

Where reasonably necessary, the organiser of the Event and/or the Venue reserves the right to make alterations to the published Event programme.


7. Refunds/exchanges

Except where We offer an applicable Place exchange, Places cannot be exchanged or refunded after purchase unless the Event is cancelled (subject to below) or where there is a material change to the Event. Where an Event is cancelled or rescheduled (subject to below) by the Venue, where an Event is cancelled or to circumstances beyond Our control, or where there is a material change to the Event, You will be entitled to claim a refund from Us in accordance with this clause.

A ‘material’ change is a change which, in Our reasonable opinion, makes the Event materially different to the Event that purchasers of the Place, taken generally, could reasonably expect.

The reduction in competition days or competition target amounts shall not be a material change, nor shall the cancellation of courses or ceremonies, nor shall any change in WFTF and SAFTAA rules.

Where an outdoor Event is cancelled or curtailed because of adverse weather, We shall not be liable to make any refund or pay any compensation beyond the refunds that may be payable under the Venue’s or Event’s insurance.

Where such a refund is sought You must bring this to Our attention as soon as possible upon becoming aware of such. The refund for Places equals the face value of the Places. In order to claim Your refund, please apply in writing to Your point of purchase.

Refunds shall only be made to the person who purchased the Places and, when possible, be made using the same method as was used to purchase the Places.

These Terms and Conditions do not and shall not affect Your statutory rights as a consume ,as contained in the Consumer Protection Act, Act 68 of 2008.

8. Liability

Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by You are at Your own risk. Liability for the cancellation or rescheduling of an Event, or for material changes to an Event, will be limited to the refund as set forth in Section 7.

Neither We nor the Venue will be responsible for any loss, theft or damage of Your personal belongings, other than caused as a result of Our negligence or that of the Venue or the Promoter or other breach of statutory duty.

It is Your responsibility to ensure You have adequate insurance for any risks not covered by the SAFTAA public liability insurance.


9. Cancelled/Re-scheduled Events

Where an Event is cancelled or rescheduled, we will use every reasonable endeavor to notify You using the details You provided Us with at the time of ordering. We do not guarantee that You will be informed of such cancellation before the date of the Event.

It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering.


10. Use of details and Data Protection

We are committed to protecting and respecting Your privacy. ,as the grace period for compliance with the Protection of Personal Information Act (POPIA) has not expired, we will in addition to the South African legislation also comply with the European Union GDPR.

By accepting these terms, You accept the following policy for You and on behalf of those You register for.

The type of data that We collect and process includes:
Your name and/or username.
Your email addresses.
Your IP addresses.
Your physical address.
Your competition equipment list.
Your competition results.
Your image may be captured by video or photography during the Event.
Further data may be collected if You choose to share it, such as if You fill out fields on Our website
We collect some or all of this information in the following cases:
You register as a member on this site.
You fill out our contact and/or registration form.
You browse this site. See “Cookie policy” below.
You fill out fields on Your profile.
You register or someone on Your behalf registers for WFTF 2023

How Your personal information is used

We may use Your personal information in the following ways:

For the purposes of making You a registered member of our site, in order for You to use this site.
We may use Your email address to inform You of activity on our site or to communicate with You or those whom You provide details for.
Your IP address is recorded when You perform certain actions on our site. Your IP address is never publicly visible.
To provide a record to the public of the competition, in perpetuity.

Other ways we may use Your personal information.

In addition to notifying You of activity on our site which may be relevant to You, from time to time we may wish to communicate with all members any important information such as newsletters or announcements by email. You cannot opt-out of such emails in Your profile as they are mandatory for the running of WFTF 2023.

We may collect non-personally identifiable information about You during Your interaction with our site. This information may include technical information about the browser or type of device You’re using. This information will be used purely for the purposes of analytics and tracking the number of visitors to our site.

Keeping Your data secure

We are committed to ensuring that any information You provide to us is secure. To prevent unauthorized access or disclosure, we have put in place suitable measures and procedures to safeguard and secure the information that we collect.

Cookie policy

Cookies are small text files which are set by us on Your computer which allow us to provide certain functionality on our site, such as being able to log in, or remembering certain preferences.

This site uses cookies for numerous things, including:

Registration and maintaining Your preferences. This includes ensuring that You can stay logged in and keeping the site in the language or appearance that You requested.
Analytics. This allows us to determine how people are using the site and improve it.
Advertising cookies (possibly third-party). If this site displays advertising, cookies may be set by the advertisers to determine who has viewed an ad or similar things. These cookies may be set by third parties, in which case this site has no ability to read or write these cookies.

Rights

You have a right to access the personal data we hold about You or obtain a copy of it. To do so please contact WFTF 2023. If You believe that the information we hold for You is incomplete or inaccurate, You may contact WFTC 2021 to ask us to complete or correct that information.

You also have the right to request the erasure of Your personal data where this data is not critical to the purpose of WFTF 2023.


11. Resale/use of Places and property

You may not re-sell or transfer a Place.


12. Void Places

Any Place obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Place shall be void. Any person seeking to use such a void Place to gain or provide entry to an Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action.

Void Places are non-refundable.


13. Restrictions on the purchase of Places

Places may be restricted to a maximum number per application. Any such restriction shall be notified to You at the time You book the Places. We reserve the right to cancel Places purchased that are more than the maximum number and without Your agreement, and without prior notice unless the purchase of an excess was due to Our error.


14. Conditions of Admission

The management of the Venue reserves the right to refuse Place holders admission to the Venue in reasonable circumstances including for health and safety, licensing reasons or where a Place is void.

The management of the Venue also reserves the right to request that Place holders leave the Venue at any point on reasonable grounds and may take any appropriate action to enforce this right. By way of example, the Venue may remove a Place holder who:

  • has behaved in the Venue in a manner which, in the reasonable opinion of the Venue has, or is likely to affect the enjoyment of other visitors; or
  • uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
  • in the reasonable opinion of the Venue is acting under the influence of alcohol or drugs; or
  • fails, when required, to produce proof of identity or age.

You must comply with instructions and directions given by Venue and Our staff and stewards.

No refunds will be given to Place holders who are refused entry or ejected due to their own behaviour as suggested in, but not limited to, the examples above.


15. Restrictions and prohibitions

The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside any Venue is permitted.

By attending an Event, Place holders and Spectators consent to filming and sound recording of themselves. The Venue and Us may use such films and recordings (including any copies) without payment.

Place holders shall not bring into the Venue or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing material’s.

Mobile telephones and messaging equipment must be switched off during the Event.

Alcohol may only be consumed in public bars and other authorised areas. Smoking and vaping is not permitted unless within a designated smoking Area (if any).

The following are not permitted within any Venue:

  • animals (except for guide dogs and dogs kept always on a leash, and only in outdoor areas);
  • laser pens
  • illegal substances.

The management of the Venue reserves the right to conduct security searches from time to time and confiscate any item which, in the reasonable opinion of the management of the Venue, may cause danger or disruption to other members of the audience or the Event or is one of the items not permitted in the Venue as listed above.

Every effort shall be made to admit latecomers to Events at a suitable break in the Event, which may be the interval, but late admission to the competition cannot be guaranteed.


16. Health and Safety

Place holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Event.

If Place holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be provided when ordering Places. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.


17. Dispute Resolution

If any dispute arises out of these Terms and Conditions, We will attempt to settle it. To this end We shall use Our reasonable endeavors to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to both parties.


18. Waiver

If We delay or fail to enforce any of these Terms and Conditions It shall not mean that We have waived our right to do so.


19. Assignment

We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.


20. Severability

If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.

Third Parties: No rights or liabilities shall accrue to any third party in terms of this contract, and no third party shall be able to enforce the terms thereof, unless You are acting as the disclosed agent of a principal. If acting as the disclosed agent of a principal, no rights or liabilities shall accrue to you, those being the rights and liabilities of the principal. This contract and no part thereof shall be construed as a stipulatio alteri.

Supervening impossibility: Should performance of Our obligations created by this contract become absolutely and objectively impossible, and such impossibility is brought about by vis major or casus fortuitous, and thus not Our actions or negligence, but by forces beyond Our control, We will be discharged from performing those obligations.


21. Amendments and variations

We intend to rely on the written terms set out here in this document as well as the written terms and conditions of the Venue and the Promoter. You should read the terms and conditions carefully before entering into the contract to ensure that they contain everything that You consider has been agreed. If they do not then You should contact Us before concluding the agreement.

After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both You and We agree. to such variation or amendment. No variation or amendment shall have any effect unless it is reduced to writing and accepted by both parties, including this paragraph.


22. No Partnership or Agency

Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.


23. Entire agreement

These Terms and Conditions, and the terms and conditions of the Venue and the Promoter and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties.

Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not)-other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.


24. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in all respects in accordance with South African law and the parties agree to submit to the exclusive jurisdiction of the Magistrate’s Court of South Africa. This contract shall be deemed to have been concluded within the area of jurisdiction of the Magistrate’s Court for the district of Lesedi held at Heidelberg (G).
